En Parashat Mishpatim, la Tor\u00e1 establece la infraestructura para establecer una sociedad enderezada. Uno de los mandamientos m\u00e1s sorprendentes es: \u201cNo hagas acepci\u00f3n de personas con el pobre en su pleito\u201d (\u00c9xodo 23:3). A primera vista, esto parece casi contrario a la naturaleza humana. \u00bfAcaso la Tor\u00e1, que predica la misericordia, la bondad y la ayuda a los pobres, nos instruye espec\u00edficamente aqu\u00ed a detener nuestra compasi\u00f3n?<\/p>\n\n\n\n

El mandamiento de los Dinim (Leyes) es una obligaci\u00f3n positiva y proactiva para los Hijos de No\u00e9. La Tor\u00e1 advierte al juez, y a la sociedad en su conjunto, contra la tendencia emocional a inclinar el juicio a favor del pobre simplemente por su pobreza. La justicia es un valor absoluto que no depende del estatus socioecon\u00f3mico. Como dictamina Maim\u00f3nides (Leyes del Sanedr\u00edn, Cap\u00edtulo 20, Ley 7), el prop\u00f3sito de un tribunal es la b\u00fasqueda de la justicia, no la pr\u00e1ctica de la caridad.<\/p>\n\n\n\n

La mitzv\u00e1 de los \u201cDinim\u201d no es meramente t\u00e9cnica; nos exige depurar nuestro sistema judicial y nuestra conciencia social de prejuicios. La igualdad ante la ley es la \u00fanica garant\u00eda de que los pobres tambi\u00e9n puedan vivir con seguridad. En la era moderna, este mensaje cobra a\u00fan mayor peso. Asistimos a un fen\u00f3meno en el que grupos o individuos exigen inmunidad moral ante la ley. La Tor\u00e1 ense\u00f1a que nadie est\u00e1 exento de cumplir la ley.<\/p>\n\n\n\n

La obligaci\u00f3n de \u201cno hacer acepci\u00f3n de personas en los tribunales\u201d exige de nosotros una postura clara: no estar del lado de los fuertes por su poder, ni del lado de los d\u00e9biles por su debilidad, sino de la Justicia Divina.<\/p>\n\n\n\n

\u00bfHemos renunciado a la compasi\u00f3n al hacerlo? Por supuesto que no. Cuando una sociedad se comporta con Justicia Divina seg\u00fan las Siete Leyes No\u00e1jidas, la mayor\u00eda de los da\u00f1os a los d\u00e9biles se previenen autom\u00e1ticamente. Para los Hijos de No\u00e9, a quienes se les orden\u00f3 establecer un sistema legal, este es un cimiento fundamental para rectificar el mundo. Construir una sociedad donde la verdad sea la luz que gu\u00ede el sistema, sin prejuicios, es la manera de preparar al mundo para ser un instrumento que cumpla la voluntad de Hashem. Solo mediante un sistema de verdadera justicia podemos crear un espacio donde la paz pueda existir.<\/p>\n\n\n\n
