In other words, when do we say that a human being\u2014male or female\u2014is accountable for what they do?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This question exists not only in Jewish law but also in general society, where different countries assign different legal ages for responsibility, including criminal liability. However, our focus here is the perspective of the Torah and classical Jewish sources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We will examine multiple texts and opinions. This is not a simple topic, and there are different approaches. I will present them as clearly as possible, based on what I understand to be the opinion of the Rebbe, while acknowledging that other interpretations exist.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Torah Source: The Story of Shechem and Dina<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the Torah, in the story of Dina and Shechem, Dina is abducted and violated by Shechem, son of Chamor. In response, Shimon and Levi\u2014two of Yaakov\u2019s sons\u2014take revenge and kill all the males of the city after they were weakened through circumcision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Torah describes their action with the phrase:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEach man (ish) took his sword\u2026\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The key word here is <strong>\u201cish\u201d (man)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Torah is extremely precise with language, so this choice of wording raises a question: what defines an \u201cish\u201d\u2014a man?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Talmudic Interpretation and Rashi<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Talmud discusses the meaning of the term \u201cish\u201d and concludes that it refers to a person who is <strong>13 years old<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rashi explains this clearly:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The term \u201cish\u201d in the Torah refers to someone who is 13 or older.<\/li>\n\n\n\n<li>We do not find in Scripture that someone younger than 13 is called \u201cish.\u201d<\/li>\n\n\n\n<li>Therefore, when the Torah calls Shimon and Levi \u201cmen,\u201d it indicates they were 13 years old at that time.<\/li>\n\n\n\n<li>There is also a tradition supporting this age assignment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, from this source we derive the association between \u201cmanhood\u201d and the age of 13.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Rambam: Measurements Apply Only to Jews<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Rambam introduces an important principle regarding Torah \u201cmeasurements\u201d (shiurim)\u2014fixed numerical standards used in halachah.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He explains that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All Torah measurements apply specifically to Jews.<\/li>\n\n\n\n<li>Non-Jews are not bound by these fixed numerical thresholds in the same way.<\/li>\n\n\n\n<li>This includes defined ages and other exact measures found in Torah law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This becomes an important foundation for later discussion: if age 13 is a fixed \u201cmeasure,\u201d it may not automatically apply to non-Jews.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Rosh: Tradition from Mount Sinai<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Rosh addresses the question directly: where does the age of 13 come from?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He explains:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The age of accountability (bar mitzvah) is a tradition given at Mount Sinai.<\/li>\n\n\n\n<li>It is part of the oral transmission from Moshe Rabbeinu.<\/li>\n\n\n\n<li>It is considered a divinely given \u201cmeasure\u201d (shiur), with no rational derivation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">According to this view, 13 is not derived from logic or nature, but from direct tradition.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Chasam Sofer: Responsibility for Non-Jews<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Chasam Sofer builds on these ideas and makes an important distinction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He argues:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The fixed age of 13 applies to Jews as a halachic standard.<\/li>\n\n\n\n<li>For non-Jews, responsibility cannot be defined by that fixed number.<\/li>\n\n\n\n<li>Instead, responsibility depends on intellectual and mental development.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">En otras palabras:<\/p>\n\n\n\n<ul is individualized rather than age-based for non-Jews.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The \u201cDivine Code\u201d Approach<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A later synthesis (as presented in the \u201cDivine Code\u201d) combines these ideas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A non-Jew becomes accountable when they reach intellectual maturity.<\/li>\n\n\n\n<li>However, it also presents the idea that this often corresponds to:\n<ul class=\"wp-block-list\">\n<li>13 years for a boy<\/li>\n\n\n\n<li>12 years for a girl<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, it acknowledges other opinions that emphasize full dependence on intellectual development rather than age.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This creates a blended model:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Age is a general guideline<\/li>\n\n\n\n<li>Intelligence and maturity are the true determining factors<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Rebbe\u2019s Explanation: Two Conceptual Models<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Rebbe presents two underlying explanations for why age 13 marks responsibility:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>First approach: Natural development<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>At around 13 years old, most people undergo intellectual and emotional maturation.<\/li>\n\n\n\n<li>Therefore, the age reflects a natural human does not depend on logic or human development.<\/li>\n\n\n\n<li>It is simply a divine standard.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In this view:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It applies specifically to Jews.<\/li>\n\n\n\n<li>Non-Jews are not bound by this numerical rule.<\/li>\n\n\n\n<li>Their responsibility depends on individual intellectual two approaches is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>If it is natural development:<\/strong><br>Then responsibility for all humans would generally align around similar ages.<\/li>\n\n\n\n<li><strong>If it is a divine decree:<\/strong><br>Then only Jews follow the fixed age, while non-Jews are judged individually based on maturity.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Rebbe\u2019s Broader Lesson<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond the legal discussion, the Rebbe extends the idea into spiritual service:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Service through understanding<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One approach to religious life begins with understanding:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First a person understands the value of commandments<\/li>\n\n\n\n<li>Then they become motivated to act<\/li>\n\n\n\n<li>Responsibility is rooted in intellectual clarity<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Service through acceptance<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second approach is beyond understanding:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First comes action (\u201cwe will do\u201d)<\/li>\n\n\n\n<li>Understanding follows later<\/li>\n\n\n\n<li>Responsibility comes from
