(Nombres 35:25)<\/em><\/p>\n\n\n\n<p>La structure des lois relatives \u00e0 l&#039;homicide involontaire, aux villes de refuge et \u00e0 la vengeance du sang est complexe et d\u00e9concertante, notamment l&#039;id\u00e9e que la Torah autorise un civil, non d\u00e9sign\u00e9 par le tribunal, \u00e0 venger le sang du d\u00e9funt. J&#039;aborderai n\u00e9anmoins un autre point cette semaine.<\/p>\n\n\n\n<p>La Sfat Emet (Parshat Maasei) pose une question sur le verset cit\u00e9 ci-dessus : pourquoi le sursis accord\u00e9 au meurtrier involontaire est-il li\u00e9 \u00e0 la mort du Grand Pr\u00eatre ?&nbsp;&nbsp;<\/p>\n\n\n\n<p>Le Talmud mentionne un fait historique int\u00e9ressant\u00a0: la m\u00e8re du Grand Pr\u00eatre s\u2019occupait souvent des repas des habitants des villes de refuge. Elle veillait \u00e0 leur confort et \u00e0 ce qu\u2019ils soient bien nourris, esp\u00e9rant ainsi les dissuader de prier pour la mort du Grand Pr\u00eatre (Makkot 11a). Pourquoi la m\u00e8re du Grand Pr\u00eatre se souciait-elle de cela\u00a0? Apr\u00e8s tout, le fait que le meurtrier accidentel se soit retrouv\u00e9 dans une ville de refuge est le fruit du processus l\u00e9gal\u00a0; pourquoi le Grand Pr\u00eatre devrait-il voir son sort d\u00e9pendre de l\u2019\u00e9tat \u00e9motionnel et spirituel du meurtrier (notons que la Torah qualifie de meurtrier celui qui tue accidentellement)\u00a0? Et pourtant, c\u2019est Dieu Lui-m\u00eame qui l\u2019a ordonn\u00e9 ainsi.<\/p>\n\n\n\n<p>Rachi, commentant notre verset, r\u00e9pond \u00e0 notre question ainsi\u00a0: \u201c\u00a0car le Grand Pr\u00eatre aurait d\u00fb prier pour sa g\u00e9n\u00e9ration afin qu\u2019une telle chose ne se produise jamais.\u00a0\u201d Autrement dit, en tant que chef spirituel du peuple juif, le Grand Pr\u00eatre, seul habilit\u00e9 \u00e0 p\u00e9n\u00e9trer dans le Saint des Saints et \u00e0 accomplir l\u2019expiation pour toute la nation d\u2019Isra\u00ebl, aurait d\u00fb user de sa position unique pour prot\u00e9ger les siens en pr\u00e9venant la trag\u00e9die. Tel est le niveau de conscience qu\u2019exige le leadership sacerdotal.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Le Talmud ne mentionne la pri\u00e8re qu&#039;en ce qui concerne la m\u00e8re du Grand Pr\u00eatre. O\u00f9 Rachi situe-t-il l&#039;obligation pour le Grand Pr\u00eatre lui-m\u00eame de prier de cette mani\u00e8re pour sa g\u00e9n\u00e9ration\u00a0?&nbsp;&nbsp;<\/p>\n\n\n\n<p>Plus loin dans le passage, le Talmud mentionne le lien entre l&#039;accidentel&nbsp;<\/p>\n\n\n\n<p>Le pardon accord\u00e9 au meurtrier et la mort du Grand Pr\u00eatre ne sont \u00e9tablis que si ce dernier \u00e9tait en fonction au moment du prononc\u00e9 du verdict. Si le Grand Pr\u00eatre d\u00e9c\u00e8de durant la proc\u00e9dure et que le verdict est prononc\u00e9 avant l&#039;onction d&#039;un nouveau Grand Pr\u00eatre, le meurtrier accidentel est plac\u00e9 en cit\u00e9 de refuge pour l&#039;\u00e9ternit\u00e9. En revanche, si le Grand Pr\u00eatre est oint durant la proc\u00e9dure et est en fonction lors du prononc\u00e9 du verdict, la date de son d\u00e9c\u00e8s devient la date du pardon accord\u00e9 au meurtrier accidentel.<\/p>\n\n\n\n<p>On peut se demander : est-ce juste ? Le nouveau grand pr\u00eatre n&#039;\u00e9tait m\u00eame pas en fonction au moment du meurtre \u2013 pourquoi sa vie devrait-elle \u00eatre en jeu maintenant ?<\/p>\n\n\n\n<p>Le Talmud r\u00e9pond que, car il aurait d\u00fb prier pour que le meurtrier involontaire soit reconnu innocent. C&#039;est sur cette base, conclut le Sfat Emet, que l&#039;explication de Rachi se comprend. De plus, il affirme que, parce que le Grand Pr\u00eatre porte une part spirituelle dans la trag\u00e9die, le meurtrier involontaire quitte la ville de refuge pr\u00e9cis\u00e9ment le jour de la mort du Grand Pr\u00eatre\u00a0; sa mort expie ainsi leurs fautes respectives.<\/p>\n\n\n\n<p>Deux le\u00e7ons essentielles se d\u00e9gagent de cet exemple. Premi\u00e8rement, la puissance de la pri\u00e8re est si intense qu&#039;elle peut donner la vie comme la mort. Deuxi\u00e8mement, le leadership implique la responsabilit\u00e9 de veiller \u00e0 la rectification du monde. Il est int\u00e9ressant de noter que le Grand Pr\u00eatre n&#039;\u00e9tait pas tenu de prier pour l&#039;incarc\u00e9ration de celui qui, selon la loi de la Torah, m\u00e9ritait ce ch\u00e2timent. Nous poss\u00e9dons un sens inn\u00e9 de la justice qui ne trouve sa satisfaction que lorsque celui que nous consid\u00e9rons comme coupable paie pour ses actes. En effet, lorsque le jugement de la Torah est appliqu\u00e9 correctement \u2013 m\u00eame s&#039;il entra\u00eene l&#039;exil ou l&#039;ex\u00e9cution \u2013 le Nom de Dieu est sanctifi\u00e9 dans le monde, et c&#039;est un motif de louange. Mais cette distinction est r\u00e9serv\u00e9e \u00e0 la Loi divine, et non \u00e0 notre propre d\u00e9sir de vengeance.
