{"id":20883,"date":"2025-02-18T07:49:31","date_gmt":"2025-02-18T06:49:31","guid":{"rendered":"https:\/\/sukkatshalom-bneinoach.com\/?p=20883"},"modified":"2025-08-17T14:40:16","modified_gmt":"2025-08-17T13:40:16","slug":"truth-and-falsehood","status":"publish","type":"post","link":"https:\/\/sukkatshalom-bneinoach.com\/fr\/truth-and-falsehood\/","title":{"rendered":"PARACHAT MISPATIM 5785 \u2013 RUTH ET LE MENSONGE"},"content":{"rendered":"<p><\/p>\n\n\n\n<p class=\"has-text-align-right\"><strong>\u05d1\u05e1 \"\u05d3<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mishpatim (<a href=\"https:\/\/www.sefaria.org\/Exodus.21-24?lang=he-en&amp;utm_source=aish.com&amp;utm_medium=sefaria_linker\" target=\"_blank\" rel=\"noreferrer noopener\">Exode 21-24<\/a>\u00a0)<\/h2>\n\n\n\n<p>L&#039;une des mitsvot les plus connues de la paracha de cette semaine est \u201c M&#039;dvar Sheker Tirchak \u201d, l&#039;ordre de se d\u00e9tourner du mensonge. Bien que cette mitsva rel\u00e8ve des lois du tribunal juif, elle s&#039;applique \u00e9galement \u00e0 la vie quotidienne. Cependant, selon la loi juive, il existe un certain nombre de situations o\u00f9 mentir est permis, voire obligatoire. Il s&#039;agit d&#039;une situation tr\u00e8s inhabituelle, o\u00f9 la Torah interdit quelque chose, puis l&#039;autorise dans certains cas.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote1sym\">1<\/a><\/sup>&nbsp;Cela soul\u00e8ve la question de savoir comment comprendre ce ph\u00e9nom\u00e8ne en g\u00e9n\u00e9ral, et plus pr\u00e9cis\u00e9ment, quand est-il interdit de mentir et quand est-ce permis ?<\/p>\n\n\n\n<p>Premi\u00e8rement, il est instructif d&#039;analyser les exceptions \u00e0 l&#039;interdiction de mentir. Le Talmud, dans Yevamot, traite de ce sujet.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote2sym\">2<\/a><\/sup>\u00a0enseigne que c&#039;est, \u201c<em>mutar leshanot mipnay haShalom<\/em>\u201d\u00a0\u2013 Il est permis de d\u00e9former la v\u00e9rit\u00e9 pour pr\u00e9server la paix. Le Talmud prouve m\u00eame que Dieu l\u2019a fait en rapportant \u00e0 Abraham les paroles de Sarah, mais Il a omis de pr\u00e9ciser que Sarah avait dit qu\u2019Abraham \u00e9tait vieux.\u00a0\u00bb (Voir Kesubot dans le Talmud)<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote3sym\">3<\/a><\/sup>, Beis Shammai et Beis Hillel divergent quant aux paroles \u00e0 prononcer \u00e0 un mari\u00e9 au sujet de sa fianc\u00e9e. Beis Shammai soutient qu&#039;il faut dire toute la v\u00e9rit\u00e9, m\u00eame si elle n&#039;est pas flatteuse, tandis que Beis Hillel estime qu&#039;il est permis de louer la Kallah m\u00eame lorsque les louanges ne sont pas m\u00e9rit\u00e9es. Comme toujours, la halakha suit Beis Hillel\u00a0; il convient donc de suivre son approche. Enfin, le Talmud, dans Bava Metsiah, affirme que les \u00e9rudits de la Torah ne mentent que dans trois domaines (li\u00e9s \u00e0 l&#039;humilit\u00e9, \u00e0 la modestie et \u00e0 la bienveillance). Il en d\u00e9coule clairement qu&#039;il est permis, voire correct, de mentir dans ces situations.<\/p>\n\n\n\n<p>Le fait que tous ces exemples soient permis indique que les mensonges abord\u00e9s dans le Talmud ne sont en r\u00e9alit\u00e9 pas interdits par la Torah. Ce point est d&#039;ailleurs soulign\u00e9 par les commentaires plus anciens\u00a0: le Sefer Yeraim<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote4sym\">4<\/a><\/sup>&nbsp;Il \u00e9crit que l&#039;interdiction de mentir selon la Torah ne s&#039;applique que lorsque le mensonge nuit \u00e0 autrui. Il explique que c&#039;est pourquoi Beis Hillel consid\u00e8re qu&#039;il est permis de faire l&#039;\u00e9loge de la mari\u00e9e, car le mari\u00e9 l&#039;a d\u00e9j\u00e0 \u00e9pous\u00e9e\u00a0; mentir \u00e0 ce sujet ne lui porte donc pas pr\u00e9judice. Rabbeinu Yonah<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote5sym\">5<\/a><\/sup>&nbsp;Il \u00e9crit dans le m\u00eame esprit que l&#039;interdiction de la Torah de mentir ne s&#039;applique pas lorsque le mensonge ne nuit pas \u00e0 la personne (il appelle cela \u2018<em>mah bekach&#039;\u2019<\/em>Ceci explique pourquoi les exemples pr\u00e9c\u00e9dents ne constituent pas une interdiction de la Torah. Dans chaque cas, la personne \u00e0 qui l&#039;on ment n&#039;en subit aucun pr\u00e9judice.<\/p>\n\n\n\n<p>Il est important de noter que Rabbeinu Yonah poursuit en affirmant que m\u00eame les mensonges qui ne nuisent pas \u00e0 autrui sont g\u00e9n\u00e9ralement interdits, du moins d&#039;un point de vue rabbinique, selon un verset des Proverbes (Mishlei), car mentir sans raison est intrins\u00e8quement mal. Cependant, comme ils ne sont pas interdits par la Torah, les rabbins les ont autoris\u00e9s dans les cas pr\u00e9cis abord\u00e9s dans le Talmud, o\u00f9 mentir n&#039;est pas consid\u00e9r\u00e9 comme un mal.<\/p>\n\n\n\n<p>Nous comprenons d\u00e9sormais pourquoi certaines permissions de mentir dans les sources rabbiniques ne contredisent pas l&#039;interdiction du mensonge (Sheker) dans la Torah, car elles ne portent pas pr\u00e9judice \u00e0 autrui. Cependant, d&#039;autres passages du Talmud autorisent le mensonge m\u00eame au d\u00e9triment d&#039;autrui.<\/p>\n\n\n\n<p>Le Talmud \u00e0 Yevamot<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote6sym\">6<\/a><\/sup>&nbsp;Le texte rapporte une histoire o\u00f9 Rabbi Chiya et Abaye ont promis de l&#039;argent \u00e0 un homme qui ne souhaitait pas prononcer la chalitsa (une forme de divorce l\u00e9gal dans certaines situations), mais apr\u00e8s qu&#039;il eut accept\u00e9, ils ont avou\u00e9 l&#039;avoir dup\u00e9 (meshateh ani bach). (Gemara dans Nedarim)<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote7sym\">7<\/a><\/sup>&nbsp;Il est permis, selon la jurisprudence, que si quelqu&#039;un tente de s&#039;approprier ind\u00fbment un bien appartenant \u00e0 autrui, il peut mentir et affirmer que ce bien ne lui appartient pas. Il lui est m\u00eame permis de faire un serment de nier sa propri\u00e9t\u00e9, par exemple en jurant de ne pas manger de pain si ce bien lui appartient, \u00e9tant entendu qu&#039;il ne s&#039;agira que d&#039;un serment ponctuel. En temps normal, un tel serment est interdit, mais dans ce cas pr\u00e9cis, il est permis.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote8sym\">8<\/a><\/sup><\/p>\n\n\n\n<p>Dans ces cas-l\u00e0, la personne tromp\u00e9e subit assur\u00e9ment un pr\u00e9judice, ce qui sugg\u00e8re que le mensonge est inclus dans l&#039;interdiction de mentir donn\u00e9e par la Torah. D\u00e8s lors, comment les Sages peuvent-ils autoriser le mensonge dans de telles situations\u00a0? Ce probl\u00e8me ne se limite pas \u00e0 la Guemara\u00a0: l&#039;un des r\u00e9cits les plus c\u00e9l\u00e8bres de la Torah semble \u00e9galement illustrer comment l&#039;un des patriarches a menti au d\u00e9triment d&#039;autrui. Il s&#039;agit de l&#039;histoire de Jacob qui a tromp\u00e9 son p\u00e8re Isaac afin de recevoir les b\u00e9n\u00e9dictions au d\u00e9triment de son fr\u00e8re a\u00een\u00e9 \u00c9sa\u00fc.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote9sym\">9<\/a><\/sup>&nbsp;Comment Yaakov a-t-il pu mentir de fa\u00e7on \u00e0 causer clairement du tort \u00e0 Esav ?<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote10sym\">10<\/a><\/sup>&nbsp;Rav Yaakov Kamenetsky<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote11sym\">11<\/a><\/sup>&nbsp;Il est permis d&#039;utiliser la ruse pour tromper une personne malhonn\u00eate. \u00c9sa\u00fc avait dup\u00e9 Isaac en lui faisant croire qu&#039;il \u00e9tait juste et digne des b\u00e9n\u00e9dictions, alors qu&#039;en r\u00e9alit\u00e9 il ne l&#039;\u00e9tait pas. Par cons\u00e9quent, Jacob fut autoris\u00e9 \u00e0 agir de mani\u00e8re apparemment malhonn\u00eate afin d&#039;emp\u00eacher \u00c9sa\u00fc, le trompeur, de recevoir les b\u00e9n\u00e9dictions.<\/p>\n\n\n\n<p>L&#039;approche du Rav Kamenetsky enseigne que lorsque la Torah interdit de mentir au d\u00e9triment d&#039;autrui, cela n&#039;inclut pas le mensonge lorsque cette personne est elle-m\u00eame menteuse ou agit de mani\u00e8re r\u00e9pr\u00e9hensible. Ceci explique \u00e9galement les passages du Talmud mentionn\u00e9s pr\u00e9c\u00e9demment qui autorisent le mensonge m\u00eame lorsqu&#039;il nuit \u00e0 autrui. Dans chaque cas, l&#039;autre personne agit mal ou est elle-m\u00eame trompeuse, et il est donc permis de mentir afin d&#039;emp\u00eacher la r\u00e9alisation de ses projets immoraux.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote12sym\">12<\/a><\/sup><\/p>\n\n\n\n<p>Il reste encore \u00e0 comprendre, d&#039;un point de vue philosophique, pourquoi il est permis de mentir dans les situations susmentionn\u00e9es. Rav Eliyahu Dessler<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote13sym\">13<\/a><\/sup>\u00a0Il est n\u00e9cessaire de revoir notre compr\u00e9hension de la d\u00e9finition de la v\u00e9rit\u00e9 et du Sheker selon la Torah. L&#039;Emes est ce qui conduit au bien et \u00e0 l&#039;accomplissement de la volont\u00e9 divine, tandis que le mensonge y fait obstacle. Ainsi, si, par exemple, une personne est \u2018 brutalement honn\u00eate \u2019 et r\u00e9v\u00e8le au mari\u00e9 la v\u00e9rit\u00e9 crue sur sa fianc\u00e9e, elle lui cause une souffrance inutile, ce qui est manifestement contraire \u00e0 la volont\u00e9 divine. De m\u00eame, si quelqu&#039;un rapporte les propos d&#039;autrui et s\u00e8me ainsi la discorde, il agit \u00e9galement contre la volont\u00e9 divine.<sup><a href=\"https:\/\/aish.com\/truth-and-falsehook\/#sdfootnote14sym\">14<\/a><\/sup>. Enfin, si une personne agit elle-m\u00eame de mani\u00e8re malhonn\u00eate ou immorale d&#039;une autre fa\u00e7on, la d\u00e9jouer et contrecarrer ses plans n\u00e9fastes est conforme \u00e0 la volont\u00e9 de Dieu.<\/p>\n\n\n\n<p>Nous avons vu que la d\u00e9finition de la v\u00e9rit\u00e9 et du mensonge dans la Torah est bien plus profonde que la simple question de l&#039;exactitude technique des mots. En effet, la v\u00e9rit\u00e9 (Emes) apporte le bien au monde, tandis que le mensonge produit l&#039;effet inverse. L&#039;histoire suivante illustre ces id\u00e9es\u00a0: un jour, un \u00e9tudiant de yeshiva \u00e9tait assis avec le grand rabbin Ha\u00efm Ozer Grodzinski lorsqu&#039;un autre \u00e9tudiant fit irruption dans la pi\u00e8ce, porteur d&#039;une bonne nouvelle. Rav Ha\u00efm Ozer exulta et remercia l&#039;\u00e9tudiant. Peu apr\u00e8s, un autre \u00e9tudiant entra avec la m\u00eame nouvelle, ignorant que Rav Ha\u00efm Ozer en avait d\u00e9j\u00e0 connaissance. \u00c0 la surprise du jeune homme qui l&#039;accompagnait, le rabbin r\u00e9agit comme s&#039;il n&#039;avait jamais entendu la nouvelle et manifesta \u00e0 nouveau une grande joie et une profonde reconnaissance. Cela se reproduisit plusieurs fois, et \u00e0 chaque fois le rabbin r\u00e9agissait de la m\u00eame mani\u00e8re. Il \u00e9tait \u00e9vident que le rabbin comprenait le grand plaisir que chaque \u00e9tudiant \u00e9prouvait \u00e0 annoncer une bonne nouvelle au grand sage. En cons\u00e9quence, il d\u00e9cida qu&#039;il valait mieux cacher la v\u00e9rit\u00e9 afin de faire plaisir \u00e0 ces gar\u00e7ons.<\/p>\n\n\n\n<p>Puissions-nous tous m\u00e9riter d&#039;atteindre la compr\u00e9hension des V\u00e9rit\u00e9s selon la Torah, et non une vision \u00e9triqu\u00e9e.
