Le Chofetz Ha\u00efm en tire une conclusion : il faut agir avec innocence envers Dieu.\u00a0<strong>Bon<\/strong>, mais pas avec les autres. Dans ses relations avec autrui, il convient de faire preuve de sagesse et de r\u00e9flexion et de ne pas se laisser duper par des personnes malhonn\u00eates.<\/p>\n\n\n\n<p>L&#039;exemple qu&#039;il donnerait \u00e9tait celui de Jacob, qui \u00e9tait appel\u00e9 un \u2018<em>ish tam<\/em>\u2018 (Un homme innocent) et pourtant il fit preuve d&#039;une grande ruse dans ses relations avec Laban. Un jour, plusieurs \u00e9tudiants de la Torah se plaignirent au Chofetz Chaim d&#039;avoir \u00e9t\u00e9 escroqu\u00e9s d&#039;une grosse somme d&#039;argent par des marchands malhonn\u00eates. Il leur r\u00e9cita ce verset et fit remarquer qu&#039;ayant pass\u00e9 tant de temps \u00e0 la Yeshiva, ils s&#039;\u00e9taient habitu\u00e9s \u00e0 agir avec innocence devant Dieu. Leur erreur, cependant, fut de croire qu&#039;il \u00e9tait \u00e9galement possible d&#039;agir avec innocence devant son prochain. (2) \u00bb<\/p>\n\n\n\n<p>Cette le\u00e7on du Chofetz Chaim&nbsp;<em>zt\u201dl<\/em>&nbsp;Cela semble tr\u00e8s logique, mais il faut le concilier avec la mitsva de \u201c<em>b&#039;tzedek tishpot et amitecha<\/em>\u201d\u00a0\u2014 de juger son prochain favorablement, m\u00eame lorsqu\u2019il semble agir de mani\u00e8re n\u00e9gative. Comment est-il possible de juger quelqu\u2019un favorablement tout en doutant de sa droiture\u00a0? On pourrait r\u00e9pondre simplement que nous devons, en pens\u00e9e, juger notre prochain favorablement, mais en m\u00eame temps, prendre des pr\u00e9cautions pratiques pour \u00e9viter d\u2019\u00eatre l\u00e9s\u00e9s au cas o\u00f9 l\u2019autre personne ne serait pas digne de confiance.(3) Cette approche pose deux probl\u00e8mes\u00a0: premi\u00e8rement, il semble presque impossible d\u2019adopter une attitude aussi contradictoire envers une m\u00eame personne\u00a0; comment peut-on exiger d\u2019une personne qu\u2019elle juge sinc\u00e8rement son prochain favorablement et, simultan\u00e9ment, qu\u2019elle le traite avec suspicion\u00a0?(4) Deuxi\u00e8mement, il para\u00eet difficile d\u2019affirmer que la Torah nous ordonne d\u2019accorder le b\u00e9n\u00e9fice du doute \u00e0 des personnes dont il existe des raisons l\u00e9gitimes de se m\u00e9fier.\u00a0\u00bb.<\/p>\n\n\n\n<p>Pour concilier ces concepts, il est n\u00e9cessaire d&#039;analyser plus en profondeur la mitsva de juger favorablement. Nombre d&#039;histoires relatent des cas o\u00f9 une personne semblait agir de mani\u00e8re manifestement n\u00e9gative, alors qu&#039;en r\u00e9alit\u00e9, une explication parfois surprenante justifiait son comportement. Ces histoires laissent entendre que la mitsva de juger favorablement exige de toujours s&#039;efforcer de faire pr\u00e9sumer la bonne opinion d&#039;autrui, m\u00eame lorsque cela semble d\u00e9fier toute logique. En r\u00e9alit\u00e9, cette conception ne refl\u00e8te pas fid\u00e8lement la nature de cette mitsva.<\/p>\n\n\n\n<p>Les premiers auteurs \u00e9crivent qu&#039;il existe diff\u00e9rentes cat\u00e9gories de personnes pour lesquelles les crit\u00e8res de jugement favorable varient.(5) Il y a le \u2018<em>tsaddik<\/em>\u2018&#039;, (homme juste) le &#039;\u2018<em>beinoni<\/em>\u2018&#039;, (moyenne) le &#039;\u2018<em>rasha<\/em>\u2018&#039; (le mal) et le &#039;\u2018<em>Eino Makiro<\/em>\u2018&#039;, (\u00e9tranger).Le&nbsp;<em>tsaddik&nbsp;<\/em>est quelqu&#039;un qui ne commet pratiquement jamais de p\u00e9ch\u00e9 \u2013 \u00e0 son \u00e9gard, nous devons le juger favorablement m\u00eame si ses actions tendent fortement vers une interpr\u00e9tation n\u00e9gative :&nbsp;<em>beinoni&nbsp;<\/em>Il s\u2019agit d\u2019une personne qui, g\u00e9n\u00e9ralement, \u00e9vite le p\u00e9ch\u00e9 mais qui, \u00e0 l\u2019occasion, tr\u00e9buche\u00a0; nous devons la juger favorablement dans les situations qui pourraient \u00eatre per\u00e7ues de mani\u00e8re \u00e9galement positive et n\u00e9gative, mais lorsque ses actions semblent n\u00e9gatives, il ne nous est pas command\u00e9 de la juger favorablement. (6)&nbsp;<em>rasha&nbsp;<\/em>Il p\u00e8che r\u00e9guli\u00e8rement et, par cons\u00e9quent, nous n&#039;avons pas \u00e0 le juger favorablement m\u00eame lorsque ses actions semblent positives. En effet, Rabbeinu Yonah dit que nous devrions le juger d\u00e9favorablement ! (7)&nbsp;<em>Eino Makiro<\/em>&nbsp;est quelqu\u2019un que nous ne connaissons pas \u2013 il n\u2019y a aucune obligation de le juger.(8)<\/p>\n\n\n\n<p>Ce qui pose probl\u00e8me avec toutes ces directives, c&#039;est qu&#039;elles ne sont mentionn\u00e9es ni dans la Torah ni dans les sources rabbiniques. La Torah ne fait aucune distinction entre les individus\u00a0; elle nous enjoint simplement de juger notre prochain favorablement, sous-entendant que cela s&#039;applique \u00e0 tous les Juifs. O\u00f9 les autorit\u00e9s ont-elles donc per\u00e7u de telles diff\u00e9rences entre les individus\u00a0?<\/p>\n\n\n\n<p>Le rabbin Yitzchak Berkovits explique que la mitsva de juger favorablement ne signifie pas que nous devions juger irrationnellement chaque acte de mani\u00e8re positive, mais plut\u00f4t que nous devons juger les gens de fa\u00e7on logique, raisonnable et juste. Une personne peut avoir tendance \u00e0 juger autrui s\u00e9v\u00e8rement et injustement\u00a0; la Torah nous enseigne que cela est mal, mais elle ne nous enjoint pas de juger les gens de mani\u00e8re illogique.<\/p>\n\n\n\n<p>Partant de ce constat, on comprend mieux pourquoi les premi\u00e8res autorit\u00e9s ont donn\u00e9 des directives diff\u00e9rentes selon les personnes. En ce qui concerne un&nbsp;<em>tsaddik<\/em>, M\u00eame s&#039;il fait quelque chose qui semble \u00eatre un p\u00e9ch\u00e9, il est logique de supposer qu&#039;il n&#039;a rien fait de mal. Par exemple, si l&#039;on voit une personne connue pour \u00eatre tr\u00e8s stricte sur le respect des r\u00e8gles de la cacheroute entrer dans un restaurant non casher, il est logique de supposer qu&#039;elle n&#039;y va pas pour manger de la nourriture non casher. De plus, m\u00eame si on la voit porter la nourriture \u00e0 sa bouche, il est plus logique de dire qu&#039;elle a besoin de manger pour survivre et que, par cons\u00e9quent, il lui est permis de manger cette nourriture non casher \u00e0 ce moment-l\u00e0. En revanche, lorsqu&#039;un&nbsp;<em>rasha<\/em>, Par exemple, si quelqu&#039;un qui est un voleur connu fait quelque chose qui semble contredire sa tendance \u00e0 voler, il est n\u00e9anmoins logique qu&#039;il existe une mani\u00e8re n\u00e9gative d&#039;interpr\u00e9ter son comportement.(9) La m\u00eame logique s&#039;applique aux autres cat\u00e9gories \u2013 lorsqu&#039;il est logique de juger quelqu&#039;un favorablement, la Torah exige que nous le fassions, mais lorsqu&#039;il ne l&#039;est pas, il n&#039;y a pas d&#039;obligation de la Torah de juger favorablement et il y a m\u00eame des moments o\u00f9 l&#039;on devrait juger son prochain d\u00e9favorablement.<\/p>\n\n\n\n<p>Gr\u00e2ce \u00e0 cette compr\u00e9hension, nous pouvons d\u00e9sormais concilier la mitsva de juger favorablement avec l&#039;enseignement du Chofetz Chaim selon lequel il ne faut pas \u00eatre na\u00eff. La mitsva ne nous enjoint pas d&#039;\u00eatre na\u00effs ; au contraire, elle nous exhorte \u00e0 \u00eatre r\u00e9alistes et nous dit parfois que\u2026&nbsp;<strong>devrait&nbsp;<\/strong>juger les gens de mani\u00e8re d\u00e9favorable. Ainsi, lorsque nous avons affaire \u00e0 des personnes dans le monde des affaires, par exemple, \u2018<em>b&#039;tzedek tishpot<\/em>\u2018La Torah nous enseigne qu&#039;il ne faut pas \u00eatre na\u00eff, mais plut\u00f4t juger les gens avec \u00e9quit\u00e9 et justesse. Comme nous l&#039;avons d\u00e9j\u00e0 mentionn\u00e9, il est important de se rappeler que cela n&#039;est pas chose facile\u00a0: une personne peut avoir naturellement tendance \u00e0 juger injustement. Il statue qu&#039;on ne peut croire cette affirmation.&nbsp;<em>lashon hara<\/em>&nbsp;mais est autoris\u00e9 \u00e0 prendre des pr\u00e9cautions pour \u00e9viter d&#039;\u00eatre bless\u00e9.<\/p>\n\n\n\n<p>4. En effet, le Chazon Ish a soutenu que la d\u00e9cision du Chofetz Chaim mentionn\u00e9e dans la note de bas de page pr\u00e9c\u00e9dente \u00e9tait impossible \u00e0 suivre en pratique (propos rapport\u00e9s par le Rav Yitzchak Berkovits).&nbsp;<em>shlit\u201da<\/em>).<\/p>\n\n\n\n<p>5. Bien entendu, il faut reconna\u00eetre qu&#039;il est possible que la personne se corrige et que, si elle semble agir de mani\u00e8re honn\u00eate de fa\u00e7on constante, elle quitte la cat\u00e9gorie des \u2018<em>rasha<\/em>\u2018\u00a0dans ce domaine.
