Een van de meest verrassende geboden is: &quot;Wees niet partijdig jegens een arme in zijn rechtszaak&quot; (Exodus 23:3). Op het eerste gezicht lijkt dit bijna in strijd met de menselijke natuur. Geeft de Tora, die barmhartigheid, vriendelijkheid en hulp aan de armen predikt, ons hier specifiek de opdracht om onze compassie te staken?<\/p>\n\n\n\n<p>Het gebod van Dinim (Wetten) is een positieve, proactieve verplichting voor de kinderen van Noach. De Tora waarschuwt de rechter, en de samenleving als geheel, tegen de emotionele neiging om het oordeel in het voordeel van de arme te laten uitvallen, enkel vanwege zijn armoede. Rechtvaardigheid is een absolute waarde die niet afhangt van sociaaleconomische status. Zoals Maimonides stelt (Wetten van het Sanhedrin, hoofdstuk 20, wet 7), is het doel van een rechtbank het nastreven van rechtvaardigheid, niet het verrichten van liefdadigheid.<\/p>\n\n\n\n<p>De mitswa van &quot;Dinim&quot; is niet louter een technische taak; het vereist dat we ons rechtssysteem en ons maatschappelijk bewustzijn zuiveren van vooroordelen. Gelijkheid voor de wet is de enige garantie dat ook de armen in veiligheid kunnen leven. In de moderne tijd weegt deze boodschap nog zwaarder. We zien een fenomeen waarbij groepen of individuen morele immuniteit voor de wet eisen. De Tora leert dat niemand is vrijgesteld van het naleven van de wet.<\/p>\n\n\n\n<p>De verplichting &quot;toon geen partijdigheid jegens een arme in zijn rechtszaak&quot; vereist van ons een zuivere houding: kies niet de kant van de sterken vanwege hun macht, en kies niet de kant van de zwakken vanwege hun zwakte \u2013 kies de kant van de goddelijke gerechtigheid.<\/p>\n\n\n\n<p>Hebben we daarmee het mededogen opgegeven? Zeker niet. Wanneer een samenleving handelt met goddelijke rechtvaardigheid volgens de zeven Noachitische wetten, wordt het meeste leed aan de zwakkeren automatisch voorkomen. Voor de kinderen van Noach, die de opdracht hebben een rechtssysteem te vestigen, is dit een cruciale basis voor het rechtzetten van de wereld. Het bouwen van een samenleving waarin waarheid, zonder vooroordelen, de leidraad is, is de manier om de wereld voor te bereiden om een instrument te zijn dat de wil van Hashem doet.
