More Mitzvot

| A Gentile who engages in Torah study is liable to the death penalty. He should only study the Seven Mitzvot [of B’nei Noach]. The general rule is that we do not allow them to create new religions or to invent mitzvot for themselves. Let him become a righteous convert and accept upon himself all of the mitzvot or remain with his Torah [the Seven Mitzvot] without adding or subtracting anything. And if he engages in Torah study or invents new religious behaviors, we give him corporal punishment, penalize him and inform him that he is liable to the death penalty for this, although he is not executed. | עַכּוּ”ם שֶׁעָסַק בַּתּוֹרָה חַיָּב מִיתָה. לֹא יַעֲסֹק אֶלָּא בְּשֶׁבַע מִצְוֹת שֶׁלָּהֶן בִּלְבַד. כְּלָלוֹ שֶׁל דָּבָר אֵין מְנִיחִין אוֹתָן לְחַדֵּשׁ דָּת וְלַעֲשׂוֹת מִצְוֹת לְעַצְמָן מִדַּעְתָּן. אֶלָּא אוֹ יִהְיֶה גֵּר צֶדֶק וִיקַבֵּל כָּל הַמִּצְוֹת. אוֹ יַעֲמֹד בְּתוֹרָתוֹ וְלֹא יוֹסִיף וְלֹא יִגְרַע. וְאִם עָסַק בַּתּוֹרָה אוֹ שָׁבַת אוֹ חִדֵּשׁ דָּבָר. מַכִּין אוֹתוֹ וְעוֹנְשִׁין אוֹתוֹ וּמוֹדִיעִין אוֹתוֹ שֶׁהוּא חַיָּב מִיתָה עַל זֶה. אֲבָל אֵינוֹ נֶהֱרָג: |
2. Me’iri, Sanhedrin 59a

ii. Prohibitions: Torah study and Shabbat

| ‘the Torah that Moses commanded us is an inheritance of the congregation of Jacob.’ | תֹּורָ֥ה צִוָּה־לָ֖נוּ מֹשֶׁ֑ה מֹורָשָׁ֖ה קְהִלַּ֥ת יַעֲקֹֽב׃ |
2. BT Sanhedrin 59a
| Rabbi Yochanan said, “a non-Jew [idol worshipper] who busies himself with [the study of] Torah is liable to the death penalty, as the verse states (Deuteronomy 33:4), ‘the Torah that Moses commanded us is an inheritance of the congregation of Jacob.’ It is an inheritance for us, not for them.” [Objection #1] If so, let this prohibition be counted amongst the Seven Mitzvot! [Resolution #1] The Amora who reads מורשה (morasha, “inheritance”) in the plain sense, categorizes this as a form of theft. [Resolution #2] The Amora who reads מורשה as מאורסה (m’orasa, “a betrothed maiden”) compares this as one who rapes a betrothed maiden, which is punishable by stoning. [Objection #2] Rabbi Meir would say, “from where do we know that someone who is a Gentile, and engages in Torah study is like the High Priest? The verse states (Leviticus 18:5), ‘which a person does them and lives through them’. There is no mention of priests, Levites or Israelites—just האדם, (ha’adam, “a person”). From here you learn that even a Gentile who engages in Torah study is like the High Priest. That is true when they are engaged in their mitzvot. | ואמר ר’ יוחנן עובד כוכבים שעוסק בתורה חייב מיתה שנאמר (דברים לג, ד) תורה צוה לנו משה מורשה לנו מורשה ולא להם וליחשבה גבי שבע מצות מ”ד מורשה מיגזל קא גזיל לה מאן דאמר מאורסה דינו כנערה המאורסה דבסקילה מיתיבי היה ר”מ אומר מניין שאפילו עובד כוכבים ועוסק בתורה שהוא ככהן גדול שנאמר (ויקרא יח, ה) אשר יעשה אותם האדם וחי בהם כהנים לוים וישראלים לא נאמר אלא האדם הא למדת שאפילו עובד כוכבים ועוסק בתורה הרי הוא ככהן גדול התם בשבע מצות דידהו: |
III. The death penalty is theoretical
3. Kesef Mishna on Rambam, Hilchot Melachim 10:9
| “He is not killed” – Because he holds that a Noahide is only executed for violations of the seven mitzvot, and despite the fact that the gemara likens his Torah study to theft, etc., our Rabbi (the Rambam) understands this to be theoretical. | ומ”ש אבל אינו נהרג הוא משום דסבירא ליה דאינו נהרג אלא על שבע מצות ואע”ג דבגמרא אמרו שעוסק בתורה הוא בכלל גזל דכתיב לנו מורשה ולא להם ולמ”ד דדריש מורשה כמו מאורשה הוי בכלל עריות סובר רבינו שהן אסמכתות בעלמא |

| It appears to me that the Rambam’s reasoning is based on that which is written [in Tractate Sanhedrin], that such a person is not actually executed, because the question was asked [Tosefot], “there is nothing that is permitted to a Jew that is forbidden to a non-Jew”, for there are the cases of a non-Jew who observes the Sabbath or who learns Torah. In such cases, it is a mitzvah for a Jew, and prohibited to a non-Jew. Tosefot stated that the aforementioned principle of לית מדעם does not apply where it is a mitzvah for Jews. But the Rambam’s opinion is exactly the opposite—where it is not only permitted to a Jew, but is a mitzvah, there is no reason a non-Jew would be prohibited to the extent of his being liable for the death penalty because of it. | עכו”ם שעוסק בתורה וכו’. נ”ל טעם לרבינו במ”ש דאין נהרג עליה משום דהוקשה לו מה שאמרו בפרק ד’ מיתות ליכא מידעם דלישראל שרי ולעכו”ם אסור דהא איכא עכו”ם ששבת ועכו”ם שעוסק בתורה דלישראל מצוה ולעכו”ם אסור והתוס’ הקשו קושיא זו דלא אמרינן הכי בדבר שהוא מצוה לישראל ורבינו נראה לו הסברא בהפך דאדרבא דכיון דלישראל לא די שהוא מותר אלא אפילו מצוה הוי א”כ לא הוה לן לאסור לעכו”ם בכך ולחייבו מיתה |
IV. Concerns about Gentiles impersonating or giving the impression that they are Jews

| Additionally, the law is, if he engages in intense Torah study not for the sake of fulfilling its mitzvot, but to arrive at a deep knowledge of our Torah and Talmud, it is appropriate that he be punished, because other people will assume that he is a Jew, based on the fact that they see that he knows [Torah] and they will mistakenly follow his example. | וכן הדין אם עסק בתורה שלא לכונת קיום עיקרי מצוותיה אלא שלבו חפץ לירד לידיעת תורתינו ותלמודינו ראוי ליענש מפני שבני אדם סבורים עליו שהוא משלנו מתוך שרואין אותו יודע ויבואו לטעות אחריו |
V. Voluntary fulfillment of mitzvot by Noahides
- Rambam, Hilchot Melachim 10:10
| We should not prevent a Noachide who desires to perform one of the Torah’s mitzvot in order to receive reward from doing so, provided he performs it as required. If he brings an animal to be sacrificed as a burnt offering, we should receive it. If a Noachide who observes the seven mitzvot gives charity, we should accept it from him. It appears to me that it should be given to the Jewish poor for the Noachide may derive his sustenance from the Jews and they are commanded to support him if necessary. VI. The Noahide’s reward for voluntary fulfillment
- TB Avoda Zara 3a
| Rabbi Meir would say, “from where do we see that even an idolater who learns Torah is considered like the High Priest? The verse states (Leviticus 18:5), ‘[You shall therefore keep My statutes and My ordinances], which if a person does he shall live through them’. It does not say, ‘priests’, ‘Levites’, or ‘Israelites’, but rather ‘a person’. Thus, we learn that even an idolater who learns Torah is considered like the High Priest”. Rather, this comes to teach you that [non-Jews] would not receive the reward of someone who is commanded and does the mitzvah, but as someone is not commanded and does the mitzvah. | היה רבי מאיר אומר מנין שאפילו עובד כוכבים ועוסק בתורה שהוא ככהן גדול תלמוד לומר (ויקרא יח, ה) אשר יעשה אותם האדם וחי בהם כהנים לוים וישראלים לא נאמר אלא האדם הא למדת שאפילו עובד כוכבים ועוסק בתורה הרי הוא ככהן גדול אלא לומר לך שאין מקבלין עליהם שכר כמצווה ועושה אלא כמי שאינו מצווה ועושה |

5. Meiri on Sanhedrin
| if his study is performed with the intention of getting a full knowledge of the Torah where if he finds it perfect he will come back and convert, and especially if he studies and fulfills its mitzvot for their own sake, even in areas that are not from the Seven Mitzvot. | אם חקירתו על דעת לבא עד תכלית שלימות תורתינו עד שאם ימצאנה שלימה יחזור ויתגייר וכל שכן אם עוסק ומקיים עיקרי מצותיה לשמה אף בשאר חלקים שבה שלא משבע מצות: |
